Commissioner 'exceeding his power'
THE public sector union has taken its fight for job security to the Supreme Court.
Job security has been the key factor holding up pay negotiations between the Together union and the Queensland Government.
Slater and Gordon, acting for the union, lodged a Supreme Court application on Thursday to challenge the Public Service Commissioner on his employment security and contracting-out directive.
The firm's employment and industrial relations lawyer Andrew Rich said they would argue the commissioner "exceeded his power" in issuing the directive and it was therefore "invalid".
"We will argue on behalf of public sector workers that the Public Service Commissioner is not authorised by the Public Service Act to make such directives, and further, that they were made contrary to the Industrial Relations Act," he said.
