PENALTY rates for weekend workers in the retail and hospitality industries will stay, Workplace Minister Bill Shorten declared on Tuesday.

Mr Shorten addressed the House of Representatives after the government responded to the Fair Work Australia modern wage awards review.

He said the government would not be "adopting the low road of paying already low paid workers less".

But he did say he had written to the state and territory governments, asking whether they supported keeping penalty rates as they were.
