Contractors taken to court

A FORMER Warwick-based building contractor is being taken to court by the Warwick Credit Union over a debt totalling more than $600,000.

Public court documents on file in Brisbane obtained by the Daily News show that the action against Rodney John Wetzler and Janet Anne Wetzler was begun in the District Court of Queensland on October 14.

In its statement of claim filed with the court the Warwick Credit Union as the plaintiff in the matter is claiming a total of $627,798.49 due under a loan contract, along with interest and court costs.

The documents lodged by Warwick legal firm Gudkovs Power Settgast outline the facts of the claim, which include a statement that on or about July 19 2007 the Wetzlers entered into a written loan agreement with the Warwick Credit Union.

The terms of the agreement included provision of an overdraft function with a credit limit of $635,000, not to be exceeded but in September 2007 the balance was at $712,161.56.

As a result the Wetzlers were issued with a notice of default and subsequently made a series of back payments over a period extending to September last year but remained in default of the agreement.

The court documents show that in addition to the overdraft balance owed, the Warwick Credit Union will further seek $68,627 in interest and $1952 in court costs.

The Wetzler's lodged a notice of intention to defend with the court on October 31, with their current place of residence listed as Collins Creek Rd at Kyogle in northern New South Wales.

They formerly operated their Warwick construction operation from premises on McEvoy St.
