Convicted rapist has appeal bid rejected

A MAN convicted of raping and beating his partner while their children were in the same house has had his appeal thrown out.

The man, who has not been named to protect the identity of his victims, was found guilty in August last year of rape, attempted rape and assault with intent to rape for three separate attacks in a country town near Ipswich in 2007.

What seemed like a "perfect relationship" quickly soured after the woman fell pregnant with her first child to the man.

The court heard he "became more dominating and violent" as the pregnancy progressed.

A violent assault broke out on July 8, 2007, when the woman discovered suggestive text messages he sent her friend.

He said he "may as well take what he wanted" when she threatened to leave and attempted to sodomise her, the court heard.

One of the children called police, who spent half an hour at the house but received no formal complaint.

He raped her later that night and then forced her to leave the bedroom for a family dinner.

No more than a week later, the man choked and beat the woman while attempting to rape her again.

The attack ended when he "became really angry and punched the floor, breaking bones in his hand".

The woman testified at the original hearing she had planned to run away, but had no friends and fell pregnant each time she decided to leave.

She said the man threatened to kill her if she left, making it sound like a joke "but deep down she knew that she could not get away safely".

The state removed the children in 2008 before the couple separated in 2011.

Queensland Court of Appeal president Margaret McMurdo ordered the guilty verdict be upheld.
