Cop shoots man after finding him having sex in pool

AN off-duty police officer has shot and critically injured a man in Florida - after he found him having sex in his pool.

The deputy reportedly walked into the private pool area of his Boca Raton apartment complex and found a couple who did not live there engaged in sexual activity.

He identified himself as an off-duty officer and told them to leave, to which the pair reluctantly complied, local news station WPTV reports.

However shortly after, the deputy claims that they returned and the man, named locally as Tony Ribeiro, hovered over him in a 'threatening manner'.

He alleges that Mr Ribeiro then attempted to hit him with a wine or champagne bottle, according to the police report.

The deputy responded by shooting him. Residents say they heard four or five gunshots. Mr Ribeiro is now in hospital in a critical condition.

The incident is under investigation and the off-duty officer has been placed on administrative leave as is standard protocol, Palm Beach County Sheriff's Office said.
