Council hits back at misconduct claim from councillor

THE fallout from last week's fiery Southern Downs Regional Council meeting continues, with the council distancing itself from comments made by an outspoken councillor.

At the meeting, Cr Jamie Mackenzie again accused the Mayor of breaching the Local Government Act by "not giving councillors sufficient time to consider the final budget papers".

He also accused the council of inappropriate communications with department officials.

Using an email from Department of Local government acting director-general Stephen Johnston, Cr Mackenzie tried unsuccessfully to move that the council seek its own independent legal advice and not that of officers from government departments.

A statement from the council has taken aim at Cr Mackenzie, brushing aside his claims.

"Southern Downs Regional Council wishes to state clearly that there have been no acts of misconduct undertaken in the development of the 2015/2016 budget," the statement reads.

"Council also wishes to indicate it will continue to seek advice of a general nature from staff at the Department of Infrastructure, Local Government and Planning."

Cr Mackenzie has also been accused of failing to table the report and not providing councillors with correspondence to give them context.

"It would appear that the intent of Mr Johnston's advice is somewhat different to what was presented to the council," the statement reads.

In his email Mr Johnston advised Cr Mackenzie the department did not provide legal advice to councils or councillors.

"Any advice provided by the department is general in nature only and, where legal advice is required on a particular matter, council should seek that advice through its own legal provider," he wrote.

Cr Mackenzie defended his actions.

"I simply asked in the council meeting if failure to comply with the Local Government Act, giving councillors 14 days to review the budget, constituted 'misconduct'," he said.
