Locals may foot a $50,000 against a proposed development
SOUTHERN Downs ratepayers could foot a legal bill of more than $50,000 against a proposed development in Gladfield.
The 17-lot rural residential development on Gladfield Back Rd was approved by the Southern Downs Regional Council earlier this year, subject to a number of strict conditions.
Developer Raymond Anthony Crompton has lodged an appeal against the conditions with the Planning and Environment Court.
Mr Crompton is demanding the council set aside two of the 25 conditions placed on the development.
The two conditions in question involve the provision of an easement for all-weather emergency services access to the site and street lighting.
In his appeal, Mr Crompton is arguing that the conditions are not relevant and not reasonably required.
He is also arguing against a condition that would require a concrete edge strip on a new road.
Councillors approved legal fees of more than $50,000 if necessary to defend their decision.
Director of Planning and Environment Ken Harris is upbeat about resolving the issue out of court.
"We're hopeful these matters don't have to go to court and won't cost us," he said.
The appeal was lodged on October 1.
Last year the council was involved in more than a dozen legal proceedings.
Several remain ongoing.
