King-hit left man with bleeding on the brain, court hears

ONE punch thrown on a CBD street in the early hours of a weekend is at the centre of a Toowoomba District Court trial.

Lindon Gordon Langton, 23, is accused of causing grievous bodily harm to Alexander Muller, 33, by punching him in the head on Margaret St about 2.40am on December 12, 2011.

Langton has pleaded not guilty to the charge.

Opening the prosecution case, Crown prosecutor Noel Needham said Mr Muller had suffered bleeding on the brain as a result of either the blow or the subsequent fall to the footpath.

Mr Muller and a workmate at the time, Gavin Rideout, 47, had been out on the town that night.

The pair had left Fibber Magees and were walking to another nightclub when the incident occurred.

Mr Rideout told the court he had been walking a little ahead of Mr Muller and as he crossed the street had turned to see where his mate was.

He said he saw two men crossing paths with Mr Muller and that the taller of the pair had punched his friend in the head.

He said Mr Muller had his hands by his side when he was struck.

Mr Muller told the court he had no recollection of the incident and, under cross examination by Langton's barrister, conceded he could not know whether he had said anything to Langton and his companion before the blow, if he had spat at Langton, if he had thrown a punch at Langton, or that he might have been mouthing off at people.

However, Mr Muller said it was not in his nature to get into arguments.

The trial continues.
