Man sues past employer for $1 million over pothole injury

A ROCKHAMPTON man is suing his former employer for $1million after he allegedly ran over a pothole while driving a 25 tonne forklift five years ago.

The 49-year-old man claims he was forcefully thrown about the cabin at the time of the incident, causing a serious back injury.

On September 10, 2008, the man was working at the QR, now known as Aurizon, freight distribution centre at the Q-Link Depot on Bolsover St.

According to documents submitted to the Supreme Court at Rockhampton, the man was shifting a loaded 10-tonne container with the forklift over a concrete pad about 8.45am.

The man has claimed that the concrete pad, which was used for unloading and loading containers, had a very rough surface with many potholes.

He hit the pothole after he looked over his right shoulder to reverse the forklift.

The man alleges the forklift was not fitted with any suspension to its wheels.

The documents state he had to undergo lumbar spine surgery, which he claims has subsequently suffered psychological injuries.

The man alleges he and his co-workers complained about both the pad and forklift needed to be fixed. He is suing Aurizon for failing to provide a safe workplace environment.

At the time the man was receiving $1010 each week, so he is now suing Aurizon for more than $700,000 for past and future economic loss.

The other $300,000 is from pain and suffering, superannuation and other expenses. He received $200,000 from WorkCover.

The man and his solicitor chose to not comment. Aurizon did not provide a response to The Morning Bulletin.
