Man to spend daughter’s wedding day behind bars

AN "HABITUAL" traffic offender will miss his daughter's wedding after being jailed for yet another string of offences.

Rodney Roy Cummings spent Wednesday and Thursday night in the cells after being arrested and charged with taking a stranger's motorbike for the day.

He fronted the Warwick Magistrates Court on Thursday and asked Magistrate Graham Lee to grant him bail on the charges.

Mr Lee - noting Cummings's 27-page traffic history and lack of permanent address - denied the request and ordered him to stay behind bars.

Cummings returned to the court yesterday and pleaded guilty to taking the Honda motorbike from a Warwick address on the morning of May 15.

The court heard the 45-year-old man forced his way into a shed that housed the bike and was spotted riding the bike along Clarke St that afternoon.

The motorbike was not registered or insured at the time and Cummings was not wearing a helmet.

Police Prosecutor Steve de Lissa told the court that when police tracked him down later, Cummings was under the influence of drugs.

He also admitted to taking the motorbike and riding it without a helmet on.

Cummings - who moved to Warwick to be near his step-daughter - was also on a suspended sentence at the time of the latest offending.

Just last month he was sentenced to three months jail, suspended for nine months, for serious assault.

Defence Lawyer Phillip Crook yesterday asked Magistrate Graham Lee to be mindful that his client was due to attend his daughter's wedding in September and a jail sentence could prevent him from doing so.

Despite the plea, Mr Lee decided jail was the only appropriate option for Cummings.

The 45-year-old was sentenced to 15 months behind bars but will released on parole after serving five months.

He was also fined $620 and disqualified from driving for three years.

An application for almost $2000 in restitution for engine damage to the bike was refused by Mr Lee, who was unconvinced the damage was a result of Cummings having used the bike.
