Mum of fugitive says market downturn left her poor

ELIZABETH Anne Turner faces going to jail because her son, former mining millionaire and accused drug kingpin Markis Scott Turner, disappeared forcing her to pay the surety for his bail.

The Courier Mail reports Elizabeth Anne Turner will face the Court of Appeal next year.

At the time she put up the surety, she claimed she was worth $3.1 million.

On May 16, Justice Peter Flanagan ordered Mrs Turner to forfeit the $70,000 cash she paid as a deposit, and pay a further $315,000 by November 17. He ordered she be jailed for a year if she failed to pay.

She has filed an application for an extension in the court of appeal, claiming to be poor after the downturn in Mackay's property market halved the value of homes.

Mr Turner was arrested by Australian Federal Police on May 27, 2011, and charged with conspiring to import and traffic drugs.

Five days later he was granted bail with conditions including a $150,000 deposit and $450,000 surety. His mother and his grandmother each paid part of the deposit.

Mr Turner's trial was due to start in September last year and in August he had stopped reporting to police.

The Australian Federal Police claimed Turner had fled, but his mother said that he had killed himself.

His wife and two children had travelled from Australia to Poland in July that year and have not returned.

In May, Justice Flanagan said evidence that Mr Turner was deceased was "entirely circumstantial".

The appeal is set to be heard next year.
