Nuisances cop $500 fines

A PAIR of men who pursed two rivals before an altercation at a fast food restaurant has fronted court.

Matthew James William Hartwell, 20 and Ryan Adrian Donovan, 20, appeared in Warwick Magistrates Court yesterday and each pleaded guilty to public nuisance.

The court heard during the early hours of October 1 the duo encountered two other males after leaving a local licensed premises and "threatened to bash them".

After being followed along Albion St by Hartwell and Donovan, the two other men tried to take refuge at a local service station to call a taxi but the console operator wouldn't let them in.

The two men proceeded to walk to McDonald's, followed closely by Hartwell and Donovan.

Police prosecutor Ken Wiggan told the court Hartwell and Donovan then assaulted the two men, punching them a number of times.

He said the assault continued, even as staff tried to separate the men, and only ceased when staff got the victims inside.

The following day police spoke with Hartwell and Donovan, who said they were very drunk and had little memory of the night before.

The court heard the two men pursued by Hartwell and Donovan chose not to press assault charges.

Defence counsel for the Warwick men denied any assault and described the incident as a "fight".

Acting magistrate Haydn Stjernqvist warned the men - who have histories of similar offences - they needed to stop their loutish behaviour, before they mess with someone who surprises them.

Hartwell and Donovan were each convicted and fined $500 for the incident.
