Offender earns a stint in prison

A WARWICK man has been told he will ultimately become his own jailer if he continues to thumb his nose at the law.

Andrew Barton Clarke-Davis, 23, fronted Brisbane District Court yesterday after he was found to have breached a suspended sentence imposed on him in the Warwick District Court in 2012.

The court heard Clarke-Davis was days away from serving out the suspended sentence for drug and explosives-related offences when he failed to report to authorities as required.

He reported a few days later with a certificate explaining his absence but the authorities did not buy it.

Defence barrister James Godbolt told the court the breach was minor at best.

"The breaching offence can be classified as trivial," he said.

"His parole has been cancelled and he will stay in custody regardless of the outcome in this matter until other unrelated matters are dealt with in the magistrates court."

Judge Julie Ryrie, who imposed the initial suspended sentence in 2012, said she did not view the breach to be minor.

"I have given Clarke-Davis the benefit of the doubt once before where I let him walk out of Warwick District Court with a suspended sentence," she said.

"You were sentenced by me for very serious conduct.

"This breach of bail was in relation to another, unrelated, offences that you have allegedly committed since then."

Judge Ryrie said she was concerned those outstanding matters were also drug related.

"If you keep getting in strife the period of detention will get longer and longer," she said.

"Ultimately you are your own jailer."

Judge Ryrie activated the suspended sentence for an additional month.

She ordered Clarke-Davis be released on July 2.
