Pair jailed over vicious assault
TWO Stanthorpe men who used their boots as weapons during a vicious head stomping assault have been put behind bars.
Jeffrey Vincent Summers and his co-accused Lionel Bruce Haidley, both 51, pleaded guilty to one charge of grievous bodily harm in the Warwick District Court yesterday.
The attack came after the two men - who lived in neighbouring units to the victim - pledged to teach him a lesson over their belief he had dobbed in Summers for having a cat in his apartment.
The violent altercation left the victim with substantial injuries, including intracranial bleeding, a fractured eye socket, fractured rib, multiple jaw fractures and pain, swelling and numbness to his face.
The court heard that Summer and the victim got into an argument on January 14, 2010. Summers then left and found Haidley and the two men returned to the victim's unit.
The court was told a previously barefoot Summers was now wearing boots, as was his co-accused. It heard Summers and Haidley dragged the man back inside his unit and both men used their boots to stomp the victim's head, chest and stomach.
After some time Haidley was heard to have told Summers he believed the man had "had enough" to which Summers replied "No, give him a bit more". The violence resumed and the man was rendered unconscious.
The pair then left the victim's unit, leaving the battered man lying unconscious on the floor, where he stayed until the next morning.
Excerpts from a victim statement were read to the court by the Crown Prosecutor during proceedings.
It detailed the man's plight since being attacked and spoke of having eight of his teeth either missing or damaged as a result of the attack, constant headaches and nausea, a proneness to jaw infections that has left him with speech difficulties and an ongoing fear he feels, having to brave going out in public.
It was also heard the man now suffers from anxiety and depression and has difficulty sleeping due to the ongoing pain in both his neck and jaw.
Judge McGill sentenced Summers to three-and-a-half years jail, with 12 months actual jail time.
His co-accused Haidley, received a slightly softer three-year sentence, to serve 10 months behind bars.
