Teen set for jail stint after spitting on police

NINETEEN-year-old Kerry Anne Murray will spend at least five months behind bars after she spat in a police officer's face.

Warwick District Court Judge Gregory Koppenol said one who commits such a disgusting act should expect jail time.

The incident occurred on December 8 last year when police were called to a disturbance at a Warwick home.

Murray was verbally abusive to police and was taken back to the station.

While police were logging her in she refused to sit down and spat in the officer's face.

The spit landed in the officer's 'mucus membranes in the eyes and mouth'.

Crown prosecutor Kathleen Millican said Murray had a history of run ins with police.

"Her behaviour towards police has continued to escalate," she said.

"The police officer has undergone many tests since the incident and will continue to get more to make sure he doesn't have any diseases."

Davies said despite the disgusting act, Murray had a child who would suffer if she was put into jail.

"Her kid is just 12 months old and she obviously needs her mother," Mr Davies said.

"She was working at Woolworths in Dalby before she had the child and she does plan to go back.

"She knew it was the wrong thing to do and did write a letter of apology to the officer."

Mr Koppenol said police officers should not be subject to this type of treatment while protecting the community.

"Your child would have been around five months old when you were doing this Miss Murray," he said.

"Your child was either in the house full of drunks or elsewhere, you didn't seem to have much consideration for your baby at the time.

"The max penalty for this kind of act was doubled from seven to 14 years several years ago."

Mr Koppenol said the penalty being doubled indicated parliament had grave concerns for this behaviour and courts needed to listen.

Murray was sentenced to 15 months jail, eligible for parole in December.

"Young people need to learn to respect authority," he said.
