Store window ‘smashed’ by butt of rifle

FORMER Killarney man Luke James Weier will be sentenced in May over the alleged armed robbery of the Legume General Store in October 2011.

Weier was supported by family and friends yesterday at Lismore District Court when he entered a guilty plea to aggravated break and enter with intent.

The prosecution withdrew charges against Weier of aggravated break and enter, assault with intent to rob and aggravated assault with intent to rob.

It is alleged that at 4.30am on October 27, Weier was armed with a .22 Remington rifle when he approached the Legume General Store and yelled for someone to let him in.

The court heard a witness thought she heard the sound of a gun being fired on that night.

The prosecution said police were unable to find a bullet casing or any bullet holes at the scene.

"There are no references in the Crown case that the gun was discharged," the prosecutor said.

Weier stands accused of waking the husband-and-wife owners of the Legume store by smashing the front window with the butt of his rifle before getting into a struggle with the husband who was trying to wrestle the rifle from him.

It is further alleged Weier was injured on jagged glass from the broken window, before he fled the scene.

Nothing was taken during the incident.

Police tracked Weier down in May last year.

He appeared in the Warwick Magistrates Court before being extradited to New South Wales.

He was denied bail twice in two days, but was finally released on bail last May.

Judge Wells adjourned Weier's sentencing until May 9.

She ordered a pre-sentence report be prepared by probation and parole authorities.

Judge Wells also requested a psychologist's report on Weier.

Weier remains free on conditional bail until sentencing.
