Man sues for $1.6 million after toilet stop goes wrong

A 23-YEAR-OLD former miner is suing for over $1.6 million after a car crash left him with serious neck and back injuries.

The man, who has not been named for privacy reasons, was travelling on the Burnett Hwy at 12.50am on August 13, 2013 when he pulled over between Ban Ban Springs and the Tansey turnoff to urinate.

Court documents lodged in the Supreme Court at Rockhampton state he parked his ute facing south, 4 metres to the west of the northbound lane.

After urinating, the man got back into his car and was sitting in cab with the engine running when a truck, travelling north in the northbound lane, veered to its left and collided with the stationary vehicle.

The documents allege the crash was caused by the negligence of the truck driver who failed to keep a proper lookout, pay due care and attention, slow down or steer clear of the ute and was travelling too fast for the conditions.

The man is suing both the driver and insurance company Suncorp for $1,660,452.37 after suffering neck, lower back and psychiatric injuries.

The damages include $516,129 in lost wages in the past, with the man unable to continue in his role at Curragh North at Blackwater, where he was earning $1600 net a week.

The documents state the man would have moved to and been employed by Caval Ridge Mine at Mackay were it not for the crash and resulting injuries.

Included in the damages is also an amount of $802,400 for future economic loss, with the documents stating the man will earn on average $1000 less per week in various occupations.

Suncorp Insurance declined to comment on the matter, which is still before the courts.
