Warwick man on last chance to avoid jail sentence
A WARWICK man narrowly avoided jail time yesterday in the Magistrates Court.
Raymond Leslie Nean pleaded guilty to two wilful damage charges arising from an incident in Rose City Shoppingworld on November 27.
Magistrate Bevan Manthey noted the 20-year-old was on a suspended jail sentence.
"I am getting sick of seeing your face," Mr Manthey said.
"You would have been looking at three to five months with one served if it had been heard at the same time (as the other offences).
"This is your very last opportunity - the rest is up to you when you walk out that door."
The Warwick man was charged after allegedly striking a Christmas tree in the shopping centre, which was caught on the centre's CCTV.
Police located Nean in the underground carpark who laughed when questioned about the incident.
Nean was then taken to the police station where police alleged he was rude and argumentative.
"If this matter had been heard with the other you would have gotten actual jail time," Mr Manthey said.
"Not even a month later you get charged with these, even though they are not as serious."
Solicitor Kevin Rose noted the incident took place prior to the suspended sentence being handed down.
"It seems my client has an issue with alcohol, which he is addressing of his own volition," Mr Rose said.
"He is undertaking a TAFE course and working hard."
Mr Manthey sentenced Nean to a 12-month probation order.
"It would be a backward step if you were given jail time now," he said.
"Your history catches up with you at the end of the day."
